An Australian incarcerated in the US military camp at Guantanamo Bay on terror charges has told his family that he is on the brink of madness. "I feel as though I am teetering on the edge of losing my sanity," wrote David Hicks in a letter dated in August but only recently received by his family. He wrote of confusion and mood swings brought on by his detention.

Mr Hicks, 29, made his second appearance before the military tribunal at Guantanamo Bay on Monday. His lawyers are arguing that his military trial, scheduled for 10 January, should be dropped. The charges against him include conspiracy to commit war crimes, attempted murder and helping the enemy during the 2001 US-led war in Afghanistan. "I feel as though I’m teetering on the edge of losing my sanity after such a long ordeal, the last year of it being in isolation," Mr Hicks wrote to his father. "I’ve reached the point where I’m highly confused and lost, overwhelmed if you like. I suffer extreme mood swings every half hour, going from one extreme to another," he continued. "The decisions I’m making, which are no doubt important, are often done without thought or sometimes care. All decisions are made in chains, including being chained to the floor."
Why doesn’t somebody misplace a belt or a shoelace in his cell? In a couple of minutes, no more depression, and dinner with Allah...
There have been widespread reports of routine harsh treatment at Guantanamo, including isolation from the outside world, the use of bright lights and loud music, and limited exercise.
No mention of videotaped beheadings...
But Mr Hicks’ family were surprised to receive the letter as previous correspondence from their son has been heavily censored by the US military authorities. "Depression seems to be their preferred order of the day," wrote Mr Hicks. "I spend an average of 350 hours by myself between brief visits. No doubt this situation has negative psychological effects which will also permanently scar me."
Permanently scar him? Oh, heavens, no!
David Hicks has pleaded innocent to charges brought against him by the US military. The Muslim convert and former abattoir worker faces a maximum of life imprisonment. He is one of two Australian citizens held at Guantanamo Bay. The other, Egyptian-born Mamdouh Habib, was arrested in 2001 in Pakistan. His family denies he has any links with al-Qaeda, saying he was captured while looking for a school for his children.

Detention, Treatment, and Trial of Certain Non-Citizens in the War Against Terrorism

By the authority vested in me as President and as Commander in Chief of the Armed Forces of the United States by the Constitution and the laws of the United States of America, including the Authorization for Use of Military Force Joint Resolution (Public Law 107-40, 115 Stat. 224) and sections 821 and 836 of title 10, United States Code, it is hereby ordered as follows:

Section 1. Findings.

(a) International terrorists, including members of al Qaida, have carried out attacks on United States diplomatic and military personnel and facilities abroad and on citizens and property within the United States on a scale that has created a state of armed conflict that requires the use of the United States Armed Forces.

(b) In light of grave acts of terrorism and threats of terrorism, including the terrorist attacks on September 11, 2001, on the headquarters of the United States Department of Defense in the national capital region, on the World Trade Center in New York, and on civilian aircraft such as in Pennsylvania, I proclaimed a national emergency on September 14, 2001 (Proc. 7463, Declaration of National Emergency by Reason of Certain Terrorist Attacks).

(c) Individuals acting alone and in concert involved in international terrorism possess both the capability and the intention to undertake further terrorist attacks against the United States that, if not detected and prevented, will cause mass deaths, mass injuries, and massive destruction of property, and may place at risk the continuity of the operations of the United States Government.

(d) The ability of the United States to protect the United States and its citizens, and to help its allies and other cooperating nations protect their nations and their citizens, from such further terrorist attacks depends in significant part upon using the United States Armed Forces to identify terrorists and those who support them, to disrupt their activities, and to eliminate their ability to conduct or support such attacks.

(e) To protect the United States and its citizens, and for the effective conduct of military operations and prevention of terrorist attacks, it is necessary for individuals subject to this order pursuant to section 2 hereof to be detained, and, when tried, to be tried for violations of the laws of war and other applicable laws by military tribunals.

(f) Given the danger to the safety of the United States and the nature of international terrorism, and to the extent provided by and under this order, I find consistent with section 836 of title 10, United States Code, that it is not practicable to apply in military commissions under this order the principles of law and the rules of evidence generally recognized in the trial of criminal cases in the United States district courts.

(g) Having fully considered the magnitude of the potential deaths, injuries, and property destruction that would result from potential acts of terrorism against the United States, and the probability that such acts will occur, I have determined that an extraordinary emergency exists for national defense purposes, that this emergency constitutes an urgent and compelling govern-ment interest, and that issuance of this order is necessary to meet the emergency.

Sec. 2. Definition and Policy.

(a) The term "individual subject to this order" shall mean any individual who is not a United States citizen with respect to whom I determine from time to time in writing that:

(1) there is reason to believe that such individual, at the relevant times,

(i) is or was a member of the organization known as al Qaida;

(ii) has engaged in, aided or abetted, or conspired to commit, acts of international terrorism, or acts in preparation therefor, that have caused, threaten to cause, or have as their aim to cause, injury to or adverse effects on the United States, its citizens, national security, foreign policy, or economy; or

(iii) has knowingly harbored one or more individuals described in subparagraphs (i) or (ii) of subsection 2(a)(1) of this order; and

(2) it is in the interest of the United States that such individual be subject to this order.

(b) It is the policy of the United States that the Secretary of Defense shall take all necessary measures to ensure that any individual subject to this order is detained in accordance with section 3, and, if the individual is to be tried, that such individual is tried only in accordance with section 4.

(c) It is further the policy of the United States that any individual subject to this order who is not already under the control of the Secretary of Defense but who is under the control of any other officer or agent of the United States or any State shall, upon delivery of a copy of such written determination to such officer or agent, forthwith be placed under the control of the Secretary of Defense.

Sec. 3. Detention Authority of the Secretary of Defense. Any individual subject to this order shall be --

(a) detained at an appropriate location designated by the Secretary of Defense outside or within the United States;

(b) treated humanely, without any adverse distinction based on race, color, religion, gender, birth, wealth, or any similar criteria;

(c) afforded adequate food, drinking water, shelter, clothing, and medical treatment;

(d) allowed the free exercise of religion consistent with the requirements of such detention; and

(e) detained in accordance with such other conditions as the Secretary of Defense may prescribe.

Sec. 4. Authority of the Secretary of Defense Regarding Trials of Individuals Subject to this Order.

(a) Any individual subject to this order shall, when tried, be tried by military commission for any and all offenses triable by military commission that such individual is alleged to have committed, and may be punished in accordance with the penalties provided under applicable law, including life imprisonment or death.

(b) As a military function and in light of the findings in section 1, including subsection (f) thereof, the Secretary of Defense shall issue such orders and regulations, including orders for the appointment of one or more military commissions, as may be necessary to carry out subsection (a) of this section.

(c) Orders and regulations issued under subsection (b) of this section shall include, but not be limited to, rules for the conduct of the proceedings of military commissions, including pretrial, trial, and post-trial procedures, modes of proof, issuance of process, and qualifications of attorneys, which shall at a minimum provide for --

(1) military commissions to sit at any time and any place, consistent with such guidance regarding time and place as the Secretary of Defense may provide;

(2) a full and fair trial, with the military commission sitting as the triers of both fact and law;

(3) admission of such evidence as would, in the opinion of the presiding officer of the military commission (or instead, if any other member of the commission so requests at the time the presiding officer renders that opinion, the opinion of the commission rendered at that time by a majority of the commission), have probative value to a reasonable person;

(4) in a manner consistent with the protection of information classified or classifiable under Executive Order 12958 of April 17, 1995, as amended, or any successor Executive Order, protected by statute or rule from unauthorized disclosure, or otherwise protected by law, (A) the handling of, admission into evidence of, and access to materials and information, and (B) the conduct, closure of, and access to proceedings;

(5) conduct of the prosecution by one or more attorneys designated by the Secretary of Defense and conduct of the defense by attorneys for the individual subject to this order;

(6) conviction only upon the concurrence of two-thirds of the members of the commission present at the time of the vote, a majority being present;

(7) sentencing only upon the concurrence of two-thirds of the members of the commission present at the time of the vote, a majority being present; and

(8) submission of the record of the trial, including any conviction or sentence, for review and final decision by me or by the Secretary of Defense if so designated by me for that purpose.

Sec. 5. Obligation of Other Agencies to Assist the Secretary of Defense.

Departments, agencies, entities, and officers of the United States shall, to the maximum extent permitted by law, provide to the Secretary of Defense such assistance as he may request to implement this order.

Sec. 6. Additional Authorities of the Secretary of Defense.

(a) As a military function and in light of the findings in section 1, the Secretary of Defense shall issue such orders and regulations as may be necessary to carry out any of the provisions of this order.

(b) The Secretary of Defense may perform any of his functions or duties, and may exercise any of the powers provided to him under this order (other than under section 4(c)(8) hereof) in accordance with section 113(d) of title 10, United States Code.

Sec. 7. Relationship to Other Law and Forums.

(a) Nothing in this order shall be construed to --

(1) authorize the disclosure of state secrets to any person not otherwise authorized to have access to them;

(2) limit the authority of the President as Commander in Chief of the Armed Forces or the power of the President to grant reprieves and pardons; or

(3) limit the lawful authority of the Secretary of Defense, any military commander, or any other officer or agent of the United States or of any State to detain or try any person who is not an individual subject to this order.

(b) With respect to any individual subject to this order --

(1) military tribunals shall have exclusive jurisdiction with respect to offenses by the individual; and

(2) the individual shall not be privileged to seek any remedy or maintain any proceeding, directly or indirectly, or to have any such remedy or proceeding sought on the individual's behalf, in (i) any court of the United States, or any State thereof, (ii) any court of any foreign nation, or (iii) any international tribunal.

(c) This order is not intended to and does not create any right, benefit, or privilege, substantive or procedural, enforceable at law or equity by any party, against the United States, its departments, agencies, or other entities, its officers or employees, or any other person.

(d) For purposes of this order, the term "State" includes any State, district, territory, or possession of the United States.

(e) I reserve the authority to direct the Secretary of Defense, at any time hereafter, to transfer to a governmental authority control of any individual subject to this order. Nothing in this order shall be construed to limit the authority of any such governmental authority to prosecute any individual for whom control is transferred.

Hicks charged The Pentagon announced three criminal charges yesterday against David Hicks, an Australian held at the U.S. military prison in Guantanamo Bay, Cuba, accusing him of conspiracy to commit war crimes, attempted murder and aiding the enemy. The move made Hicks, who was captured in Afghanistan in December 2001, the third captive at Guantanamo Bay -- and the first citizen of a U.S. ally imprisoned there -- to be charged with terrorism-related offenses. He will face trial under the controversial military tribunal process devised for some of those apprehended in government’s war on terrorism.

According to the Pentagon charge sheet, Hicks, 28, a high school dropout and convert to Islam who has done stints as a cowboy, boxer, shark fisherman and kangaroo skinner, attended several al Qaeda training courses at camps in Afghanistan in 2001. Leaving the country briefly, he returned after the Sept. 11, 2001, attacks to fight alongside al Qaeda and Taliban members.

In outlining its case, the Pentagon said Hicks trained in Albania in 1999 with the Kosovo Liberation Army and fought for Albanian Muslims. He converted from Christianity to Islam and, in early 2000, joined an Islamic extremist group in Pakistan known as Lashkar-e-Taiba, or Army of the Righteous, participating in clashes with Indian forces in the disputed Himalayan region of Kashmir. In January 2001, Hicks traveled to Afghanistan to attend al Qaeda terrorist training camps, where he took courses on weapons, urban tactics, guerrilla warfare and other military-related subjects, the Pentagon said. As part of a course on information gathering, Hicks conducted surveillance of various targets in Kabul, including "the U.S. and British embassies," according to the charge sheet. At that time, though, neither the United States nor Britain operated an embassy in the Afghan capital.

A spokesman for the military tribunals said yesterday that the reference was to buildings once used as embassies and still occupied, when Hicks allegedly spied on them, by employees of the United States and Britain.

Ali-bin Ramsey of the Saddam Times (The Sydney Morning Herald) has found a new cause to defend — David 'Taliban' Hicks. Ramsey sympathetically relates how an old of friend his, Derk Swieringa, complained in writing to the Government about Hick's detention in Guantanamo Bay military base (Rights missing in action and still labor can't stop the rot, 26/2).

Ramsey, being the America-hating journo he is, simply cannot tell it straight. Hicks was captured in a combat zone as a member of the Taliban. But Ramsey tries to discredit these facts by deliberately ignoring Hicks membership of the Taliban and putting captured and combat zone in inverted commas. Fortunately, most people are not stupid enough to fall for this kind of cheap rhetorical trick.

Calling the US description of the likes of Hicks as "unlawful combatants" "a wondrous piece of sophistry by any standard" he then proceeds to engage in some sophistry of his own. It is true that Hicks has not been convicted of anything. It is also true that he was a member of the Taliban, an organisation that allied itself with Al Qaeda and protected it. Hicks found his way to Afghanistan when he fought with the Kosovo Liberation Army (ethnic Albanians) against the Serbs, converting to Islam and taking the name Mohammed Dawood. That al Qaeda had operatives in Kosovo fuelled suspicions that Hicks links with this group of terrorists is closer than he had admitted. But these are facts, and facts are not what Ramsey is really about.

Ramsey complains that Hicks has been denied legal access. It would have been better if Ramsey had told readers that Hicks is not entitled to any. He was in another country fighting along side a terrorist organisation that had recently slaughtered 3,000 Americans. Under these conditions he is not entitled to any lawyer nor does he have the protection of Australian law, regardless of what the Bush-loathing Swieringa thinks.

The term "unlawful combatants" allows these thugs to enjoy the conditions of POWs without having their legal status. The advantage of this situation to the US and her allies is that these Islamo-fascists can be kept out of circulation and intensively interrogated. Something that Ramsey and his fellow America-hating friends object to. (I think it is impossible to convey to any reader the hatred that the leftwing Ramsey has for the US. It deforms everything he writes on the subject of terrorism).

The pompous Geoffrey Robertson has also had his penny's worth, arguing that Al Qaeda and the Taliban are POWs and should enjoy the protection of the Geneva Convention of 1949, which he thinks saved the lives of "of American soldiers and airmen who surrendered in Korea and Vietnam" (Australia must tell US David Hicks is a POW 16/2 ,2002)

Rubbish. Allied prisoners in Korea and US prisoners in Vietnam suffered appalling conditions and torture. I suggest Robertson read No Mercy, Leniency by Cyril Cunningham and Korea atrocity: Forgotten War Crimes 1950-1953 by Phillip D. Chinnery before he opens his mouth again.

In any case, Robertson is not morally qualified to give an opinion. The man who wanted Pinochet arrested but would not call for the mass murdering Castro's arrest is in no position to lecture to Rumsfeldt.

Considering the circumstance of Hicks capture, the organisation he fought for, and the threat that these fanatics and their terrorist brethren still pose, I think Hicks is getting off very lightly.

What I want to know is why Ramsey is so keen on getting Hicks out. A clue to Ramsey's thinking might be deduced from the fact that he frequently writes vicious anti-American articles without condemning terrorism. Perhaps he thinks America deserved 9/11, and getting Hicks released would be his way of giving the Yanks another well deserved slap in the face.

Downer says Hicks is a complete fool

Australian alleged al-Qaeda fighter David Hicks deserved to suffer harsh
American retribution for his involvement in the terrorist organisation,
Foreign Minister Alexander Downer said.

Hicks is one of almost 200 Taliban and al-Qaeda members being held by US
forces in Guantanamo Bay in Cuba after being captured in Afghanistan.

Mr Downer said the Australian public would have no sympathy for the
26-year-old from Adelaide.

"We have no illusions about this - he was a very, very foolish person to
have got involved with an organisation like al-Qaeda," Mr Downer said .

"It was an extraordinarily foolish thing to do. Inevitably, the Americans
are going to take a strong stand against anyone who has been involved with
al-Qaeda because this is an organisation which is openly, not just by
practice but by rhetoric, committed to killing Americans.

"We are an ally of the United States and we agree with them. They're
perfectly entitled to take very tough action against organisations that are
committed to killing their citizens and David Hicks was a complete fool to
get wound up in an organisation like al-Qaeda, a complete fool.

"I don't think the majority of Australian citizens sympathise with someone
who has done something as foolish as that."

It was still uncertain what fate awaited Hicks and whether he would be tried
under US or Australian law but Mr Downer, in London for a Commonwealth
Ministerial Action Group meeting, was sure he would not face the death
penalty.

"We in Australia oppose the death penalty in any circumstances," Mr Downer
said.

"But there's no indication that he faces the death penalty. I don't think
that is likely at all.

"What happens to him is still depending on obtaining the precise details of
what he has done and making judgements on whether to prosecute and under
what jurisdiction to prosecute."

Mr Downer said there were still some cloudy legal issues over whether Hicks
should be treated as a prisoner of war under the Geneva convention.

"It depends very much on the circumstances in which they were detained and
what they were doing when they were detained," he said.

"There is an argument that one of your own nationals who is detained
fighting against your own country does not fall within the definition of a
prisoner of war under the third Geneva Convention."

THE father of Guantanamo Bay detainee David HICKS was heckled at a Eureka Stockade event this morning. Terry Hicks was invited to lead the dawn lantern walk in the Victorian city of Ballarat today, a move criticised by many including Premier Steve Bracks. The ABC reported Mr Hicks kept a low profile during the walk and received support from about 1,000 people who marched with him during the event. However, after he spoke at the Eureka Centre, a small number of people accused him of using the Eureka story for his own political purposes. "How dare you hijack this event," one man yelled from the crowd.

Mr Hicks told the ABC: "I don’t mind people having a go at me but could they please come and ask me the story personally." His 29-year-old son has been held on Guantanamo Bay for three years since he was captured with Taliban forces in Afghanistan, and is accused of fighting with the Taliban against US and coalition forces. During his speech, Mr Hicks said in some areas justice had not changed in a century and a half. "One hundred and 50 years ago there was a lot of injustices," he said. "Today, particularly on my side and what I’m doing, we still have injustices."

Today’s dawn event was one of many held to commemorate the 150th anniversary of the Eureka Stockade. The battle at the Eureka Stockade was the result of tensions between miners and the Victorian government over unjust taxes. Miners, who were not landholders, were not allowed to vote and were being targeted by crippling taxes enforced by an over-zealous police force. Rioting miners burnt down the Eureka Hotel and built the Eureka Stockade out of wooden slabs and carts on the site of the burnt-out hotel. Two days later, at 4.45am, government forces stormed the camp and about 30 miners and six soldiers were killed.
